산업기술 보호와 관리를 위한 법적 개선방안
기술패권 경쟁이 심화된 시대에 국제사회에서 경제안보와 기술주권 전략의 중요성이 높아지면서 국가 차원에서 복합적인 경제위기에 대응해야 한다는 공감대가 형성되고 있다. 이에 각 부처에서는 우리나라의 주요 기술 분야에서 기술력 강화 및 우수인재의 보호를 위해 다양한 정책을 발표하고 법률을 제･개정하고 있다. 한편, 부처마다 국가적으로 중요 한 기술을 선정하고 유사한 법･정책들을 경쟁적으로 수립함에 따라 국가예산과 조직의 운 영이 효율화되지 못하고 혼란이 야기될 것이 우려된다. 따라서, 보다 거시적인 관점에서 관련 논의를 검토하고 법체계를 정비할 필요가 있다. 본 연구는 산업기술 주요 법률인 ｢산업기술의 유출방지 및 보호에 관한 법률｣, ｢국가첨 단전략산업 경쟁력 강화 및 보호에 관한 특별조치법｣, ｢산업기술혁신 촉진법｣, ｢국가전략 기술 육성에 관한 특별법｣에 대한 입법적 논의를 정리하였다. 또한 선행연구들을 수집하여 분석함으로써 산업기술 법･정책의 주요 쟁점을 도출하고 개선방안을 제안하였다. 주요 쟁 점은 i) 법･정책의 추진체계, ii) 적용대상, iii) 산업기술 보호를 위한 규제와 제도, iv) 산업기 술 육성을 위한 지원정책, v) 산업기술에 관한 국제적 대응 등 5개로 구분하였다. 경제안보 와 연결되는 기술의 보호와 육성을 위해서는 먼저 유사한 정책을 조정하는 거버넌스 체계 와 전문기관의 기능을 강화하고, 법의 적용을 받는 이해관계자들이 법률관계와 규제를 명 확히 예측하고 해석할 수 있도록 해야 한다. 구체적인 경제안보 전략은 모두 추진체계와 적용대상에서 파생되므로, 이에 대한 조정과 정비를 선결하여 국가경쟁력을 위한 정책수단 들 또한 체계화할 필요가 있다.
Legal Improvements to Protect and Manage Industrial Technology
As competition for technological hegemony intensifies and economic security and technological sovereignty strategies gain importance internationally, there is a consensus that governments must take active roles in addressing complex economic crises. Each ministry has announced various policies and enacted or revised laws to strengthen technological capabilities and protect scientists and technicians in major technological fields. However, with each ministry competitively enacting similar laws and policies, concerns arise about inefficiency and complexity within the national budget and organization. Therefore, it is necessary to review related studies and approach the legal system from a more macro perspective. This study summarizes the legislative debate on major industrial technology laws, such as ｢Act on Prevention of Divulgence And Protection of Industrial Technology｣, ｢Act on Special Measures For Strengthening The Competitiveness of, And Protecting National High-tech Strategic Industries｣, ｢Industrial Technology Innovation Promotion Act｣ and ｢ Special Act on Promotion of National Strategic Technology｣. Additionally, it derives major issues in industrial technology law and policy through analysis of previous research and proposes measures for legal improvement. The main issues are the five categories: i) Governance, ii) Subject to the law, iii) Protection regulation, iv) Promotion support, and v) International projection. To protect and manage technology, governance and specialized institutions must be strengthened, and legal relations and regulations must be clarified. Accordingly, policy measures for economic security should be specified.
